Soilworks, LLC (“Soilworks,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information you provide when using our IntelliGuide mobile application (the “App”).

The App is designed primarily for business-to-business use by customers, prospective customers, and other business representatives interacting with Soilworks.

This Privacy Policy explains what personal information we collect through the App, how we use and protect that information, when it may be disclosed, and the choices available to you.

1. Personal Information We Collect

The App collects only limited personal information necessary to identify and communicate with business users.

Personal information you may provide includes:

• Full name
• Email address
• Telephone number

We do not use the App to request or intentionally collect sensitive personal information such as Social Security numbers, government identification numbers, payment card or bank account information, health information, biometric information, or other similar sensitive personal information.

Because the App is designed for business use, you may also provide business-related information necessary for Soilworks to respond to an inquiry, prepare recommendations or quotations, or provide products or services. This may include company, project, product, quantity, delivery, application, or other business information. Business information is treated as personal information when applicable law considers it identifiable to an individual.

2. How We Use Your Information

Soilworks may use information collected through the App to:

• Create and maintain a business contact or customer record.
• Respond to inquiries and requests for information.
• Prepare and communicate product recommendations, pricing, quotations, and related information.
• Communicate regarding current or potential orders, projects, freight, delivery, or other business matters.
• Provide customer service and respond to questions.
• Communicate important changes relating to Soilworks products or services, including relevant pricing, availability, service, or operational updates.
• Maintain our business records and customer relationship management systems.
• Protect the security and integrity of the App and Soilworks systems.
• Comply with legal and regulatory requirements.
• Send marketing or promotional communications regarding Soilworks products, services, and related information, as permitted by applicable law.

We will use personal information only for legitimate business purposes and in accordance with this Privacy Policy and applicable law.

3. Marketing Communications

Soilworks may occasionally use your business email address to send marketing or promotional communications concerning Soilworks products, services, educational information, product announcements, or other information that may be relevant to your business.

Every Soilworks marketing email includes an unsubscribe option that allows recipients to opt out of future marketing communications.

When you unsubscribe from marketing communications, Soilworks will process the request in accordance with applicable law.

Choosing not to receive marketing communications does not prevent Soilworks from sending necessary operational, transactional, or business relationship communications.

For example, Soilworks may continue to contact you regarding:

• Requests for quotations or pricing
• Existing projects or orders
• Freight or delivery matters
• Customer-service requests
• Account or application administration
• Pricing changes or other information relevant to an existing business relationship
• Important service or product information related to an existing business relationship
• Other communications necessary to respond to a request you have made

These operational and transactional communications are separate from marketing communications and may be necessary to provide requested products, services, quotations, or customer support.

4. How We Share Information

Soilworks does not disclose personal information except as necessary to operate our business, provide the App and related services, respond to your requests, or comply with applicable law.

Personal information may be provided to service providers that assist Soilworks with functions such as:

• Customer relationship management
• Application hosting and operation
• Email and business communications
• Information technology and security
• Data storage and backup
• Customer support
• Business operations

These service providers are authorized to process information only as necessary to provide services to Soilworks and are expected to protect the information they process.

Soilworks may also disclose information when reasonably necessary to:

• Comply with applicable laws, regulations, court orders, subpoenas, or other legal processes.
• Protect the rights, safety, property, or security of Soilworks, our customers, or others.
• Detect or prevent fraud, misuse, or security incidents.
• Complete a merger, acquisition, reorganization, financing, sale of assets, or similar business transaction, subject to appropriate protections.

Soilworks does not sell or rent personal information to third parties for their independent marketing purposes.

5. Storage and Customer Relationship Management

Information submitted through the App may be stored in Soilworks’ customer relationship management (“CRM”) system and other business systems used to manage customer inquiries, quotations, projects, orders, communications, and business relationships.

Access to this information is limited to Soilworks personnel and authorized service providers with a legitimate business need for access.

6. Data Retention

Soilworks retains personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including maintaining the business relationship, responding to quotations and customer inquiries, maintaining necessary business records, complying with legal obligations, resolving disputes, and enforcing agreements.

When information is no longer reasonably required, Soilworks may delete or de-identify it in accordance with its normal business and data-retention practices.

If you unsubscribe from marketing communications, Soilworks may retain limited information necessary to record and honor your opt-out preference.

7. Access, Correction, and Deletion

You may request access to, correction of, or deletion of personal information associated with you.

The App provides an in-app method for requesting deletion of your personal information and associated account data.

To protect customer information, Soilworks may take reasonable steps to verify the identity of the person submitting a privacy or deletion request.

Upon receiving a verified deletion request, Soilworks will delete or de-identify personal information that it is not required to retain for legitimate business, contractual, security, regulatory, or legal purposes.

Certain information may need to be retained when required by law or when reasonably necessary to:

• Maintain records relating to completed business transactions.
• Fulfill legal, tax, accounting, or regulatory requirements.
• Resolve disputes.
• Prevent fraud or misuse.
• Protect the security of Soilworks systems.
• Enforce agreements.

8. Account and Data Deletion

Users may initiate deletion of their App account and associated personal information directly through the App.

When an account deletion request is submitted, Soilworks will process the request and delete or de-identify applicable personal information from its systems, including associated CRM information, except for information Soilworks is required or permitted to retain for legitimate business or legal purposes.

Deletion of an App account will not require Soilworks to delete information that applicable law requires Soilworks to retain or information reasonably necessary for legitimate business recordkeeping, completed transactions, fraud prevention, security, dispute resolution, or enforcement of agreements.

9. Data Security

Soilworks uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse.

No method of electronic transmission or storage can be guaranteed to be completely secure. Accordingly, Soilworks cannot guarantee absolute security, but we take reasonable measures appropriate to the nature of the information we maintain.

10. International Users

Soilworks is a United States-based company.

If you access the App from outside the United States, information you provide may be transferred to, stored in, or processed through systems used by Soilworks and its service providers in the United States or other locations where those service providers operate.

Where required by applicable law, Soilworks will take appropriate measures relating to international transfers and processing of personal information.

11. Privacy Rights

Depending on where you reside, applicable privacy laws may provide additional rights regarding your personal information, including rights to:

• Request access to personal information.
• Request correction of inaccurate information.
• Request deletion of personal information.
• Obtain information about how personal information is used or disclosed.
• Object to or restrict certain processing.
• Withdraw consent where processing is based on consent.

Soilworks will respond to applicable privacy requests in accordance with applicable law.

12. Children’s Privacy

The App is intended for business users and is not directed to children.

Soilworks does not knowingly collect personal information through the App from children under 13 years of age.

If we learn that information from a child under 13 has been submitted through the App, we will take reasonable steps to delete that information.

13. Third-Party Services and Links

The App may contain links to third-party websites, services, or applications.

Soilworks is not responsible for the privacy practices of independent third parties. Users should review the privacy policies of those services before providing information directly to them.

Service providers acting on Soilworks’ behalf are expected to handle information consistent with their contractual obligations and applicable privacy and data-protection requirements.

14. Changes to This Privacy Policy

Soilworks may update this Privacy Policy periodically to reflect changes in the App, our business practices, legal requirements, or technology.

When the Privacy Policy is updated, the “Last Updated” date at the top of this policy will be revised.

Material changes may also be communicated through the App or through other appropriate means.
