The regular meeting of Council of the Municipal District of Wainwright No. 61 was held in the Municipal Administration Building, Wainwright, Alberta on Tuesday, May 18, 2010 commencing at 9:00 a.m.

Present: Reeve Bob Barss, Councillors Phil Valleau, Oscar Buck, Ted Wilkinson and Myron Zajic. Staff present: Assistant Municipal Administrator Bonnie Milton, Secretary Stacey Davis and from the Star News, Kelly Clemmer (9:27 a.m. to 1:48 p.m.).

Absent: Clr. Shelly Andersen and Clr. Morley Muldoon due to prior commitments.

Agriculture Service Board

The Agricultural Fieldman, James Schwindt, attended the meeting from 9:07

a.m. to 9:15 a.m. and reported to Council on the activities of the Agricultural Services Department for the past month.

The Wainwright Agricultural Society has submitted Perkins Farms Inc. and Evolution Farming Ltd. as the 2010 AMA Farm Family.

The Agricultural Fieldman distributed a list to Council of ratepayers who have entered into the 2010 No-Spray/Haying Option agreement.

Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 approve the 2010 No-Spray/Haying Option agreement list as presented and add E 2-45-9 W4M and SE 11-45-9 W4M to the list. CARRIED

The Agricultural Fieldman presented Council with their options for events, tours and golf costs for the 2010 ASB Summer Tour.

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 cover the costs of the extra tours for the delegates attending the 2010 ASB Summer Tour. CARRIED

Council recommended that motion #216.10 be forwarded to the next policy review meeting.

Safety & Utilities

The Safety & Utilities Manager, Preston Iverson, attended the meeting from 9:15 a.m. to 9:31 a.m. and reported on the activities of his department for the past month.

It was the consensus of Council that the Safety & Utilities Manager look at hiring 24 hour security for Fabyan Campsite for May Long Weekend from Thursday at 5:00 p.m. until Sunday morning. They will enforce the posted rules and when the maximum number of occupants is reached they will turn away vehicles. The second option is to shut down the campsite, with the assistance of the R.C.M.P., Friday morning if it is found to be in disarray.

Moved by Clr. Zajic that the Municipal District of Wainwright No. 61 authorize for Riverdale Mini-Park, the purchase of two 2010 golf carts from Willerton Ski-Doo & E.Z. Go Golf Carts, less the trade-in of a 2002 golf cart (S/N AG0229-169710) and a 2004 golf cart (S/N AG0435-426636) for a cost of $2,395.00 plus G.S.T. per cart. CARRIED

DELEGATIONS

Wayne Worthing and Marie came to Council from 9:32 a.m. to 9:50 a.m. and discussed with Council the options available for the reclamation of his land where the construction fire happened on LR #1 at SE 15-44-5 W4M on April 20, 2010.

Public Works

The Director of Public Works, Shannon LaHaye, and the Director of Transportation, Mark Greibrok, attended the meeting from 9:33 a.m. to 11:53 a.m. and from 1:13 p.m. to 2:20 p.m. and reported to Council on the activities of their respective departments for the month.

Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 approve the Director of Public Works’ report as presented. CARRIED

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 order a tandem load of Durasoil for dust control for a cost of approximately

$16,000.00 and Councillors are to submit their lists for the Durasoil dust control to the Director of Transportation. CARRIED

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 approve the Director of Transportation’s report as presented. CARRIED

Administration submitted a memo to Council regarding previous motions on grader operator training from EK Pass.

It was the consensus of council to move the grader operator training to the 2011 planning meeting.

The Director of Public Works presented the 2010 Bridge Priority List to Council.

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 approve the 2010 Bridge Priority List as presented and forward it to Alberta Transportation. CARRIED

A copy of a memo from the Municipal Administrator was received and distributed to Council regarding the construction fire on LR #1 at SE 15-44-5 W4M. – No Action

A copy of a letter from Alberta Transportation was received and distributed to Council advising that the Municipal District of Wainwright No. 61’s projects submitted under the Resource Road Program for 2010 did not receive funding and they recommend that municipalities pick their best project and put it forth rather than multiple applications.

A copy of a letter from Gary Kisio from M. Pidherney’s Trucking Ltd. was submitted to Council requesting that they be granted a 45 day extension for Ribstone Road because of council’s recommendation that they not operate a night shift.

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 set up a meeting with Williams Engineering Canada Inc. prior to the June council meeting and then meet with M. Pidherney’s Trucking Ltd. to discuss the extension request for Ribstone Road further. CARRIED

DELEGATIONS

Joe Rinas attended Council from 10:33 a.m. to 10:49 a.m. and discussed with Council the trees that he had cleared at Clear Lake and apologized for doing it without permission and for clearing too many trees.

Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 be authorized to proceed with an agreement for Joe Rinas to clean up and remove the trees he has cut down on municipal reserve (SW 12-44-5 W4M) and furthermore erect a rail fence once clean up is complete. CARRIED

 

Doreen Hicks attended Council from 10:58 a.m. to 11:14 a.m. and discussed with Council her issues with the construction on Range Road 2-5 and that she would like to be kept informed on the construction on the road.

The Director of Transportation reported to Council that Carillion would like to purchase 2,650 tonnes of gravel from the Municipal District of Wainwright No. 61.

Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 be authorized to sell 2,650 tonnes of gravel to Carillion for a price of $4.51 per tonne plus G.S.T. CARRIED

The Director of Transportation noted that we had budgeted $953,600.00 for the Hawkins Road terracem project for 2010 but that the quotes came in higher and we are short approximately $332,815.00 in the budget for this project.

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 authorize an additional $350,000 for the Hawkins Road terracem project. CARRIED

Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 hire Ant Construction to do the terracem (chip seal) for Hawkins Road and Greenshields Road. CARRIED

Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 be authorized to add the following yield sign in accordance with Bylaw #1334 and that this yield sign be added to Appendix A of Bylaw #1334:

A copy of a letter from Darcy Paulichuk from CIMA+ regarding a quote for geometric reviews of local roads was submitted to council.

Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 authorize CIMA+ to carry out a geometric review of about 80 miles of local roads for an approximate cost of $147.50 per mile. CARRIED

Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 adjust the land location for the Black Creek Cattle Co. Ltd. gravel agreement for 30,000 yards of gravel to the SW 19-41-4 W4M. CARRIED

Finance

The Municipal Accountant, Mary Nelson, attended the meeting from 11:30

a.m. to 11:53 a.m. and reported to Council on the finances for the past month.

Moved by Clr. Valleau that the accounts recorded on the attached list in the amount of $1,204,088.49 covered by debit memos 1398 to 1409 and cheques numbered 60879 to 61023 be approved and paid and that the payroll payments as per the attached list totaling $218,698.74 covered by EFTs numbered 900017378 to 900017504 be ratified. CARRIED

Moved by Clr. Buck that the financial statement of receipts and disbursements for the month ending April 30, 2010 be adopted as written and incorporated into these minutes. CARRIED

Administration & Taxation

A copy of the monthly status report was received and distributed to Council.

A copy of a memo from the Assistant Administrator was received and distributed to Council regarding seed cleaning plant upgrades.

Moved by Clr. Zajic that the Municipal District of Wainwright No. 61 continue to fund the Edgerton and Wainwright Seed Cleaning Plants’ capital upgrade projects at a level of 50% of cost to a maximum of $10,000 each over two year periods. CARRIED

Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 draft a resolution to bring forward to the A.A.M.D.C. zone meeting for the provincial government to impose a deposit on disposable containers. MOTION DEFEATED

A copy of a letter from the Seniors Advisory Council for Alberta was received and distributed to Council regarding Seniors’ Week 2010.

Moved by Clr. Zajic that the Municipal District of Wainwright No. 61 be authorized to sign the proclamation to designate June 7 to 13, 2010 Seniors’ Week. CARRIED

A copy of a letter from the Edgerton Sports Association was received and distributed to Council requesting sponsorship for the 2010 Edgerton Bullarama.

Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 support the 2010 Edgerton Bullarama as a gold sponsor in the amount of

DELEGATIONS

Lieutenant Colonel Paul Duff attended Council from 11:51 a.m. to 11:53 a.m. and was presented with a plaque for his dedicated years of services as the Base Commander at the Western Area Training Centre/Area Support Unit.

Reeve Barss read aloud a letter from Williams Engineering for Ribstone Road – NO ACTION

A copy of the A.A.M.D.C. Member Bulletins, Contacts and District Highlights were received and distributed to Council.

Moved by Clr. Buck that the Tax Sale Meeting be scheduled for June 15, 2010 at 2:00 p.m. in the Council Chambers if necessary. CARRIED

Health & Social Services

Protection to Persons and Property

Council discussed the different standards between fire departments and where the Municipal District of Wainwright No. 61’s liability lies.

239.10                Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 invite George Roddick to the next Council meeting to discuss where the M.D.’s liability lies and how to protect the M.D. as a funding agent with regards to the fire departments and that we contact Jubilee Insurance regarding our insurance on the issue. CARRIED

A letter was received from the Village of Chauvin regarding the Chauvin fire hall.

240.10                Moved by Clr. Buck that the Municipal Administrator and the Reeve set up a meeting with the Mayor and the Administrator from Chauvin to go over the terms of the agreement for the Chauvin fire hall. CARRIED

Municipal Property Environment

A copy of a map showing the proposed site for the waste disposal site at Ascot Heights was received and distributed to Council.

241.10                Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 approve the relocation of the waste disposal site at Ascot Heights on SW 18-44-6 W4M, Plan 7922107, Block 1, Lot 8MSR as presented. CARRIED

Bylaw No. 1494 – A Bylaw of the Municipal District of Wainwright No. 61 in the Province of Alberta being a Bylaw to amend Bylaw No. 1318, as amended to May 15, 2007, of the Municipal District of Wainwright No. 61 to amend the Land Use Designation of NE 11-44-5 W4M, SE 11-44-5 W4M, SW 12-44-5 W4M, SE 2-44-5 W4M and SW 1-44-5 W4M from Agricultural District to Direct Control District as shown on the attached Schedule “A”. Further Council for the Municipal District of Wainwright No. 61, in accordance with Section 641(3) delegates to the Development Authority, the authority to approve all Development Permit Applications received for development within this Direct Control District.

Bylaw No. 1495 – A Bylaw of the Municipal District of Wainwright No. 61 in the Province of Alberta for the purpose of imposing rates of taxation in the Municipal District of Wainwright for the fiscal year 2010 and to rescind Bylaw No. 1493.
