Certification of Environmentcal Compliance: Mohave, Arizona (TPD0706036)

Summary

Independent environmental consulting review was conducted to evaluate Soiltac® for Certification of Environmental Compliance in response to municipal procurement requirements. The evaluation addressed stormwater runoff quality, hazardous waste classification, regulatory compliance under the Toxic Substances Control Act (TSCA), Arizona Administrative Code hazardous waste criteria, and carcinogenic substance listings. Based on review of MSDS documentation, laboratory testing, and stormwater impact modeling, the product was determined to meet environmental compliance benchmarks, including National Pollutant Discharge Elimination System (NPDES) stormwater criteria and hazardous waste characterization standards. The assessment further confirmed that the product and its degradation components do not exhibit ignitability, corrosivity, reactivity, or regulated hazardous substance designation under applicable federal and state environmental regulations.

For municipalities, counties, industrial operators, and infrastructure projects requiring environmentally compliant dust control and soil stabilization solutions, polymer-based technologies offer measurable performance while aligning with regulatory standards. Dear Mr. Hurst:

Geotechnical and Environmental Consultants, Inc. (doing business as GEC) has been requested by Soilworks, LLC® to evaluate their product Soiltac® for the Certification of Environmental Compliance as requested by Mohave County in their procurement document “Invitation for Bid No. 07-B-03” in Section 2.2. Soilworks, LLC® provided us with a copy of the Material Safety Data Sheet (MSDS), specifications, and environmental data for Soiltac®, along with laboratory test reports from Aquatic Consulting & Testing, Inc. Based upon our review of these documents, we present the following paragraphs in response to Mohave County’s request.

  1. Storm water runoff from treated areas (as a result ofapplication of the specific chemical SOILSA product) shall not contain concentrations that exceed benchmark values of the parameters designated in the National Pollutant Discharge Elimination System Storm Multi-Sector General Permit for Industrial Activities.

A storm water impact analysis was performed by Aquatic Consulting & Testing, Inc. (ACT). ACT used a mathematical model to evaluate the ability of contaminants to be leached from Soiltac® based on characterization sampling performed on Soiltac® in 2003. Based upon our review of the information provided and compaison of this information to the Exhibit 4 of EPA’s document “Guidance Manual for the Monitoring and Reporting Requirement of the NPDES Multi-Sector Storm Water General Permit” issued in January 1999, we believe storm water rnoff from Soiltac® treated areas should not contain concentrations exceeding the benchmark values designated.

  1. The specific SOILSA product and its degradation products shall not contain constituents that are identified or listed as a hazardous waste under the Arizona Administrative Code RI8-8-261 or display any of the primary characteristics of a hazardous waste (ignitability, corrosiveness, or reactivity).

Based on the information provided to us in the MSDS and the Soiltac® specificati ons, we believe that Soiltac® and its decomposition products would not be a RCRA hazardous waste or a hazardous waste under A.AC. Rl 8-8-261. While test data does indicate the presence of

acetone in Soiltac®, the acetone is not used as a solvent. It is used for its evaporative properties. Therefore, based on our understanding of State and Federal regulations, the mere presence of acetone is not sufficient to classify this material as a hazardous waste. In addition, based on the MSDS, Soiltac® is not flammable (ignitable), corrosive, or reactive, so Soiltac® and its decomposition products would not display the primary characteristics ofa hazardous waste.

  1. The specific SOILSA product and its degradation products shall not contain constituents that are identified as a hazardous chemical substance or mixture pursuant to Section 7 ofthe Federal Toxic Substances Control Act [15 S.C. 2606], be designated by role an extremely hazardous chemical substance pursuant to the Arizona Environmental Quality Act, be prohibited for use by the Arizona Department ofEnvironmental Quality, the Environmental Protection Agency or any applicable law, rule, or regulation.

Based on the information provided to us in the MSDS and the Soiltac® specifications, we believe thi s product does not contain components regulated under the Federal Toxic Substance Control Act, and it is not designated as an extremely hazardous chemical by ADEQ or EPA.

  1. SOILSA products or their components and degradation products shall not be substances or composed of substances known to be, or reasonably anticipated to be, carcinogenic by the S. Department of Health and Human Services.

Based on GEC’s review of the data provided to us, Soiltac® and its components including acetone and vinyl acetate are not listed as carcinogenic by EPA or ADEQ.

  1. Current Material Safety Data Sheet (MSDS) for specific SOILSA product(s) bid. The MSDS must include all chemical compounds present in concentrations greater than 0.1 % for each product Ifadditives are added to the SOILSA type product other than water, then complete MSDS ‘s for the SOILSA base and each additive shall be provided. Mohave County Public Works reserves the right to request and obtain all original manufacturers’ MSDS’s of the submitted product upon request.

A current MSDS is attached.

Based on the information provided to us and the requirements listed by Mohave County, we believe that Soiltac® meets the environmental compliance requirements ofMohave County.

GEC’s evaluation was based on the information and data provided to us. We assumed that the information and data provided to us was true, accurate, and complete. We did not independently verify the information or data provided to us. GEC did not conduct any laboratory testing on samples ofthis product. GEC performed this review in accordance with typical industry standards for this type of work. The opinions and conclusions provided by GEC are based solely on the information provided to us and documented in this report. Additional information which was not readily available to GEC at the time of this report may result in a modification of the opinions and conclusions presented.
